Terms and Conditions
Our terms and conditions comply with existing legislation including the Sale of Goods Act 1979 ( as amended ), the Consumer Credit Act 1974 ( as amended ), if applicable, and any legislation relating to restrictive trade practices. For all business transactions between the buyer and the seller the terms and conditions of Tutbury Fires apply.
All orders for purchace are on condition that these terms are accepted by the buyer at the time of placing an order. Tutbury Fires accepts no liability for any product or service advertised, supplied or otherwise promoted on this site by any third party. Tutbury Fires does not warrant that any of the goods or services linked to or advertised on this site comply with data protection or other relevant legislation and Tutbury Fires accepts no liability for any claim arising from such goods or services. The foregoing does not affect your statutory rights.
Warranties and Guarantees
The seller guarantees the product for 12 months from the date of purchace, and we also have a satisfaction policy which means that if you are dissatisfied with the quality of the goods ,at the time of delivery, we will take the goods back immediately, and refund any monies already paid to us. You should therefore inspect the goods at the time of delivery and if you are not satisfied, refuse to accept them. Existing Manufacturers Guarantees also apply. Your statutory rights are not affected.
Before confirming an order the buyer should ensure that the goods are suitable for the purpose for which they are intended to be used. Particular care should be taken to make sure that the goods are compatable with the fuel type ie. gas electric or solid fuel.
We cannot accept liability for damage or fault caused by misshandling after delivery, or by using the goods for a purpose for which they were not intended. If you are unsure please ask.
Order Acceptance
The receipt by us of an order from a prospective buyer does not constitute or imply the acceptance of an order, or confirmation of an offer to sell. We reserve the right to refuse to sell at our own discretion, and or to limit the quantity of any particular item. Subject to any other terms and conditions contained herein an order will only be deemed to have been accepted by Tutbury Fires when we have expressly confirmed that we have accepted your order. Such acceptance may be written, verbal or by electronic means, and will constitute a Contract, subject to the laws of contract in the United Kingdom.
Dimensions and Specifications
Although every effort is made to ensure the accuracy of information both on this website and in our brochures, errors do sometimes occur, and owing to the manufacturing processes involved dimensions can vary. Stated dimensions should only be taken as a general guide, and Tutbury Fires will not accept liability for any consequences arising out of such inacuracies.
Due to the nature of the natural materials used in many of our products, colours and finishes may vary from those illustrated. Fossils, mineral intrusions and veining are to be expected in natural stone products and add to their unique appeal.
We reserve the right to alter specifications and or prices where we deem it nescessary, and without notice.
Payments
Goods will normally be paid for, in full, before delivery. Payment can be made with the order online or by telephone with mastercard or visa. Payments made by cheque must be cleared before delivery can be made.
Cash on Delivery arrangements may be made in some circumstances, by prior agreement.
All goods remain the property of Tutbury Fires untill payment is received in full. All prices are gross and in UK pounds sterling i.e., £ or GBP.
Delivery charges are not included and will therefore need to be confirmed and added at the time of order.
Returned Goods
Customers have a 7 day cooling off period after delivery during which time they are entitled to return goods for any reason. Such returned goods must be undamaged, unused and in their original wrapping. The cost of returning the goods will be the responsibility of the buyer and can be arranged by ourselves by prior agreement. In any event returns must be notified to us within 7 days from date of delivery and a return number issued. Any goods arriving at our premises without a return number will be refused.
Refunds will be made within 7days of receipt at our premises, after checking for damage and condition. A full refund will only be made if the goods are in origional and resalable condition. Assessment of their condition will be the sole decision of Tutbury Fires.
